An incendiary case over whether a Kansas church has the right to stage anti-gay protests during military funerals goes to the Supreme Court on Wednesday. The Westboro Baptist Church claims that American war casualties are God's punishment for the country's tolerance of homosexuality. Albert Snyder is suing church leader Fred Phelps for picketing the funeral of Snyder's son, U.S. Marine Lance Corporal Matthew Snyder, who was killed in Iraq in 2006.

Attorneys for Phelps are citing Flynt's landmark case against the late Reverend Jerry Falwell as part of the defense. Flynt gives CNN a reaction to his inclusion, and also teases that he's holding onto some potentially explosive political secrets.
